Question & Answer with Kyle Kimball

What changes have you seen over the last several years and what impact are they having?

Without  question  the  biggest  change  is  the  way  the  Sajen  legal  team  now  works with  our  clients.  We now offer a much more sophisticated business arrangement (Sajen Accord) where clients can cost  effectively  utilize  our  services  anytime  without  waiting  for  a  problem  to  arise  and  living  in  fear  of  a  huge bill.

Sajen is a multidisciplinary firm covering a wide range of legal areas, so what is your favourite type of legal work?

Each member of our team has differing preferences so we can easily match clients with an enthusiastic team member. Personally, I like working with clients when I can work with the key players in a strategic sense or when I can assist a business turn around through restructuring. I also like the challenge of complex commercial litigation.

And your favourite type of client?

That’s easy. Any small to medium enterprise that is privately held, is growing faster than the rate of their competitors and has the courage to break the mould. Someone with a plan that we can help see to fruition.

What are some of the highlights of the last few years where you have assisted clients?

Well, we have had a huge case load but some of the most memorable include when we assisted in a restructure and turnaround strategy for a corporate group holding in excess of $25M assets which was subject to an unexpected $5M payroll tax liability at the same time its financier chose not to renew the Group’s facilities. This involved the winding up of two entities of the group while at the same time conducting detailed objection and exemption applications and negotiating with the Group’s financier to obtain forbearance on favourable terms.

In another instance we acted for some of the creditors in the Opes Prime Stockbroking Ltd administration and liquidation (with $7M+ claims) including liaison with administrators and receivers, investigating and pursuing claims (against banks, directors et al) in the Supreme Court, advocating at creditors meetings and advising on the liquidation process.

I have to say a particular highlight though was appearing in the Court of Appeal having prepared and run the matter from start to finish. As a lawyer, in a purely professional sense, there’s nothing quite like going head to head with QC’s and 3 appeal court judges all at once and still managing to persuade them to agree with your way of thinking.
